RegenX is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Who We Are

RegenX Group Pty Ltd (ABN 30 670 812 389) operates a digital investment platform that provides access to clean energy and infrastructure investment opportunities structured through regulated vehicles, including Managed Investment Schemes (MIS) and Special Purpose Vehicles (SPVs). The platform is designed to facilitate capital formation, investor access, and ongoing asset management for real-world infrastructure assets, with digital infrastructure used to support settlement, transparency, and reporting. RegenX operates within an Australian financial services framework and may act as an investment manager and Corporate Authorised Representative of a licensed entity, while regulated functions such as custody, trustee services, and fund administration are performed by appropriately licensed third parties.

For the purposes of this Privacy Policy, “personal information” has the meaning given in the Privacy Act 1988 (Cth) and includes any information or opinion about an identified individual or an individual who is reasonably identifiable. This may include sensitive information where permitted by law, including information required for identity verification, financial information, and data collected for compliance with legal and regulatory obligations.

We may collect and hold a range of personal information necessary to provide our services, including identity information such as your full name, date of birth, residential address, and nationality, as well as contact details including your email address and phone number. In order to comply with legal and regulatory requirements, we may also collect verification information such as government-issued identification and data obtained through third-party identity verification and AML/KYC providers. Where relevant to your use of the Platform, we may collect financial information including bank account details, investment preferences, and transaction history, as well as digital asset information such as wallet addresses and blockchain transaction data associated with your activity. In addition, we collect usage and technical data, including information about how you interact with the Platform, your device and browser type, and IP address, to support platform functionality, security, and performance. We may also receive personal information from third parties such as trustees, custodians, financial institutions, and service providers where required to facilitate investments, verify identity, or comply with applicable laws.

We may also collect information from third-party service providers, including identity verification providers, AML/CTF screening services, custodians, trustees, payment processors, and digital asset infrastructure partners, where necessary to verify your identity, facilitate transactions, and comply with regulatory obligations. In addition, we collect certain information automatically through the use of cookies, analytics tools, and similar technologies that track how you interact with the Platform, including device information, IP address, browser type, and usage behaviour, in order to improve performance, security, and user experience.

4. Why We Collect Your Information

We collect, use, and process your personal information to provide and operate the Platform, including enabling access to investment opportunities, facilitating transactions and settlement processes across both traditional and digital infrastructure, and administering your account. Your information is also used to conduct identity verification and AML/CTF checks, manage risk, and comply with applicable legal and regulatory obligations. In addition, we use your information to communicate with you regarding your account, transactions, and platform updates, as well as to enhance and optimise platform functionality, security, and performance through ongoing monitoring and analysis of user activity.

We may also use your personal information to provide you with information about products, services, investment opportunities, and platform updates that we reasonably believe may be of interest to you. Such communications may be delivered via email, platform notifications, or other electronic means. You may opt out of receiving marketing communications at any time by using the unsubscribe functionality or contacting us directly.

Where lawful and practicable, you may interact with RegenX anonymously or using a pseudonym, such as when making general enquiries or browsing publicly available information. However, due to regulatory requirements, including AML/CTF obligations and investor verification requirements, it is generally not practicable for RegenX to provide access to the Platform, onboarding, or investment services without collecting and verifying your personal information.

5. Digital Assets and Blockchain

RegenX may utilise blockchain technology as part of its infrastructure to record ownership interests, facilitate the settlement of transactions, and enable the distribution of returns associated with underlying investments, with digital assets functioning as a settlement and transparency layer rather than as a replacement for traditional financial systems. Transactions recorded on blockchain networks are generally immutable and may be publicly accessible, meaning that certain data such as wallet addresses and transaction details may be visible on public ledgers, although such information is not inherently linked to personal identity without additional data. Users acknowledge that blockchain technology introduces specific risks, including technical limitations, network disruptions, and the irreversible nature of transactions once executed.

6. Disclosure of Your Information

We may disclose your personal information to third parties where necessary to provide the Platform, facilitate investments, and comply with legal and regulatory obligations, including trustees and Responsible Entities overseeing Managed Investment Schemes, custodians and fund administrators responsible for holding and managing assets, banking partners and payment providers facilitating fiat transactions, and digital infrastructure providers such as AUDD Gateway used for settlement processes. We may also disclose information to identity verification and AML/CTF service providers to satisfy compliance requirements, as well as to regulators such as AUSTRAC where required by law, and to professional advisers including legal, accounting, and audit firms supporting our operations. Any disclosure of personal information is limited to what is reasonably necessary for these purposes and is conducted in accordance with applicable privacy laws. We do not sell personal information to third parties.

Disclosure may also occur to additional service providers that support the operation of the Platform, including cloud hosting providers, cybersecurity providers, analytics providers, customer support systems, and digital infrastructure or wallet service providers. Where personal information is shared, it is limited to what is reasonably necessary and subject to appropriate confidentiality and data protection obligations.

7. Overseas Disclosure

Some of our service providers, including cloud infrastructure providers, analytics platforms, and identity verification or compliance services, may store or process personal information outside of Australia, including in jurisdictions such as the United States and other Asia-Pacific regions. Where personal information is disclosed to overseas recipients, we take reasonable steps to ensure that those parties handle your information in a manner consistent with Australian privacy laws, including by implementing contractual safeguards and working with reputable providers that maintain appropriate data protection standards.

By using the Platform, you acknowledge and consent to the disclosure of your personal information to overseas recipients where required to provide services, subject to the safeguards described above.

8. Data Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure by implementing appropriate technical and organisational security measures, including the use of secure cloud infrastructure, encryption, access controls, and internal policies that restrict access to authorised personnel only. While we are committed to maintaining a high standard of data security, you acknowledge that no system or transmission of data over the internet can be guaranteed to be completely secure, and we cannot ensure absolute security of your information.

You are responsible for maintaining the confidentiality and security of your account credentials, devices, and any digital wallet access associated with your use of the Platform. RegenX is not responsible for any unauthorised access resulting from your failure to safeguard such credentials.

9. Cookies and Analytics

We use cookies and similar technologies, including analytics tools such as Google Analytics, to collect information about how users interact with the Platform, including browsing behaviour, page usage, and session activity, in order to improve functionality, performance, and user experience. These technologies may also assist with security, diagnostics, and understanding user engagement. You can control or disable cookies through your browser settings, although doing so may affect certain features or functionality of the Platform. Cookies may also be used to support authentication, maintain session integrity, prevent fraudulent activity, and store user preferences. While cookies do not typically identify you directly, they may be linked to other information collected by the Platform.

10. Your Rights

You have the right to request access to the personal information we hold about you and to request correction of any information that is inaccurate, incomplete, or out of date. 11. AML/CTF and Identity Verification

RegenX is required to comply with Australian Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws, which include obligations to verify your identity and monitor transactions. As part of this process, we may collect and verify personal information using electronic verification services provided by third-party providers, including access to government data sources such as the Document Verification Service (DVS), as well as other databases used for identity confirmation, sanctions screening, and risk assessment. We may also conduct ongoing monitoring of transactions and account activity to detect and prevent unlawful conduct. If you do not provide the information required for identity verification or compliance purposes, we may be unable to onboard you, process transactions, or continue to provide services on the Platform.
